SAN JOSE, Calif. (AP) ? Hearings in the dispute between Thomas Kinkade's widow and girlfriend over the late artist's $66 million estate will not be conducted behind closed doors ? at least for now, a judge ruled on Monday.

Kinkade's widow, Nanette Kinkade, had sought to keep the matter private, asking Judge Thomas Cain to immediately send the case to an arbitration panel and not open probate court.

But Cain rejected that request, saying he was being asked to make findings based on very limited information, the San Jose Mercury News reported (http://bit.ly/LsDJlW ).

At the center of the dispute are handwritten notes that Thomas Kinkade's girlfriend, Amy Pinto-Walsh, says bequeath her his mansion in Monte Sereno and $10 million to establish a museum of his paintings. She was living with Kinkade and found his body when he died in April.

Nanette Kinkade, Kinkade's wife of 30 years, disputes those claims and is seeking full control of the estate. She and Kinkade were legally separated when Kinkade, 54, died of an accidental alcohol and Valium overdose.

"We're pleased that (the judge) is going to keep this matter in the probate court," Sonia Agee, Pinto-Walsh's attorney, told KGO-TV outside court. "We think it's the right place for it not only for Ms. Pinto, but also for the public interest."

The case was continued until Aug. 13.

Pinto-Walsh was present in court. Nanette Kinkade was not.

"She wants to keep things as private as she can for herself, her family, her girls, and that's what Thom wanted," Dan Casas, the attorney who appeared on behalf of Nanette Kinkade, told KGO-TV.

Kinkade, the self-described "Painter of Light," was known for sentimental scenes of country gardens and pastoral landscapes. His work led to a commercial empire of franchised galleries, reproduced artwork and spin-off products that was said to fetch some $100 million each year in sales.

In recent years, however, he had run into personal difficulties, including a 2010 bankruptcy filing by one of his companies and an arrest on suspicion of driving under the influence that same year outside Carmel.

Pinto-Walsh's lawyers filed court papers June 11 stating that she and Kinkade had planned to marry in Fiji as soon as his divorce went through.

Nanette Kinkade has painted Pinto-Walsh in court papers as a gold-digger who is trying to cheat the artist's rightful heirs. After Kinkade's death, she obtained a restraining order prohibiting the other woman from talking publicly about the artist. That confidentiality agreement is also the subject of the court proceedings.

Dell buying Quest Software for $2.36 billion

ROUND ROCK, Texas (AP) ? In a move to branch out beyond the weakening personal computer business, Dell said Monday that it's buying Quest Software for about $2.36 billion.

Dell said Quest would make it more competitive in the server, storage, networking and computing services business.

Quest helps companies manage databases and provides other corporate IT services. Quest's technology would add to its security and data protections offerings, along with other services aimed at business customers, Dell said.

With the deal, Dell, the second-largest U.S. PC maker after Hewlett-Packard Co., is trying diversify beyond the lower-margin business of making personal computers. PC sales have weakened in the last two years as consumers increasingly navigate the Internet on smartphones and tablet computers such as Apple Inc.'s hot-selling iPad.

Both Dell and HP have been buying software and technology services companies to expand beyond PCs and plumb the more fertile territory of advising big companies and government agencies on how to manage their technology needs. As part of that process, the companies hope to sell more software and computing equipment.

In late May, Dell Inc. reported disappointing first-quarter financial results and predicted weak sales in the current quarter. The computer maker said sales to government, big businesses and consumers decreased. Total product revenue fell 5 percent to $11.42 billion in the Jan.-March quarter as revenue from mobility products, software, desktop PCs, and storage products all decreased. Sales to consumers took a particularly sharp decline of 12 percent, while government sales to fell 4 percent and revenue from large businesses dipped 3 percent.

Sales to small and medium-sized businesses were a bright spot. They grew 4 percent.

Dell's acquisition comes in the midst of some belt-tightening at the company. In June, it outlined a cost-cutting plan designed to trim expenses by $2 billion over the next three years.

Quest, based in Aliso Viejo, Calif., had agreed to be bought by Insight Venture Partners for $23 per share, or $2 billion, in March, and a series of increasing bids from Insight and another bidder followed.

The March bid was a 19 percent premium to the company's closing stock price the day before the deal was announced. Dell's $28 per share offer announced Monday is a 44 percent premium to Quest's ending price of $19.40 from March 8.

The deal is expected to close in Dell's August-October quarter. Both boards have approved the deal, but Quest shareholders must still vote it through.

Quest CEO Vinny Smith, who has a 34 percent stake in Quest, had agreed to support Insight's offer in March. But he will vote his shares for the Dell deal, Quest said Monday. In a statement Monday, Smith said that with the Dell deal, Quest's products and workforce would be the "foundation" for Dell's software business.

Quest paid a $25 million breakup fee as well as $12 million for expenses to Insight and Vector Capital, which joined Insight as a partner bidder last month.

Shares of Quest Software Inc. slipped 5 cents to $27.76 in morning trading. Shares of Dell, which is based in Round Rock, Texas, dipped 8 cents to $12.44. In the last year, Dell's stock has traded in a range between $11.68 and $18.36.

Hype over Higgs boson hits new heights

Has the Higgs boson finally been detected? It's almost gotten to the point that if a discovery of some sort doesn't come out of next week's update on the multibillion-dollar subatomic search, it'll be a big surprise. But how far will the announcement go, and what will it mean for the future of physics?

To refresh your memory, the Higgs boson is the only fundamental subatomic particle predicted by theory but not yet detected. It's thought to play a role in endowing some particles, such as the W and Z boson, with mass ... while leaving other particles, such as the photon, massless. The Higgs mechanism, proposed by British physicist Peter Higgs and others in the 1960s, could have played a role in electroweak symmetry breaking, which was a key event in the rise of the universe as we know it.

The Higgs boson is so key to the current understanding of fundamental physics that Nobel-winning scientist Leon Lederman nicknamed it the "God Particle"?? a term that has been making other physicists wince ever since. Another religion-tinged cliche would be to call it the "holy grail of particle physics," as CERN physicist John Ellis has. He says finding the Higgs is a key goal for the $10 billion Large Hadron Collider.

"That's one thing that we're really looking forward to with the LHC," Ellis told me five years ago. "In fact, back when we persuaded the politicians to stump up the money to build the thing, that's probably what we told them."

Last December, the teams reported that they saw "tantalizing hints" of the Higgs' existence at a mass of around 125 billion electron volts, or 125 GeV. But the confidence in those results was not yet high enough to claim a discovery.?Now the teams behind the collider's CMS and ATLAS experiments have collected higher piles of data, at higher energy levels, sparking higher expectations.

The 5-sigma fetish
When physicists talk about their confidence, they talk in terms of statistical "sigma" levels. The higher the sigma, the less likely that the results are just a fluke. In particle physics, 3 sigma constitutes strong evidence, but it takes 5 sigma to accept the results as a discovery. At the 5-sigma level, statisticians say there's roughly one chance out of 3 million that you're leaping to the wrong conclusion, as opposed to a 1-in-1,000 chance at the 3-sigma level.?That distinction makes a big difference when you're sifting through billions upon billions of proton-on-proton collision reports.

Last year, the best that the LHC teams could do was 3.6 sigma for ATLAS, and 2.6 for CMS. Now physicists are looking for a 5.

For three weeks, the teams have been running the numbers on their experimental results in secret, so as to avoid any chance that one analysis will influence the other. Their results are to be announced during a presentation at the CERN nuclear research center in Geneva, which will be webcast starting at 9 a.m. CEST (3 a.m. ET) on July 4. Although no official word has leaked out, the unofficial word is that someone looking for a discovery could get to the magic number.

"Reports from the experiments indicate that at least one of them, if not both, will reach the 5 sigma level of significance for the Higgs signal, when they combine 2011 and 2012 data and the most sensitive channel. So, this will definitely be the long-awaited Higgs discovery announcement, and party time for HEP [high-energy physics] physicists," Columbia mathematician Peter Woit wrote on his Not Even Wrong blog a week ago.

Since then, other physicist-bloggers have been fine-tuning the expectations. Here's a selection:

• On the Resonaances blog, physicist Adam Falkowski (a.k.a. Jester) has a countdown clock ticking toward the Higgs discovery. "It is not clear, at least to me, if either of the two experiments will pass the 5-sigma fetish. But it does not really matter. ... What's going to change next Wednesday is that the status of the Higgs will be upgraded from 'almost certain' to 'beyond reasonable doubt.'"
• On Quantum Diaries, Southern Methodist University physicist Aidan Randle-Conde advises against trying to combine the data from the two teams to get to 5 sigma. "With all this pressure to get as much out of the data as possible, it's tempting to move too quickly and do what we can to get a discovery, but now is not the time to rush things," he writes.
• On the?ViXra Log, Philip Gibbs says that when CERN's researchers report their progress, "it is likely that the main question they are investigating will switch from 'Is there a Higgs Boson?' to 'Is it the Standard Model Higgs boson?'"
• On a blog titled "Of Particular Significance,"?Rutgers physicist Matt Strassler advises caution,?but also suggests getting "the cases of champagne ready, in case the time has finally come to pop the corks." He points out that a discovery announcement would by no means be the end of the story. "Even if we see strong evidence of a Higgs-like particle ... the correct understanding of that particle?? in particular, determining whether it is or isn't a 'simplest Higgs'?? may take years."
• As we approach H-Hour, you can expect to hear more via all these outlets as well as other blogs such as Cosmic Variance?and "A Quantum Diaries Survivor."

Hedging on the Higgs
What Strassler and Gibbs are saying is important: Technically speaking, CERN is unlikely to announce that the Higgs boson has been definitively discovered. It's more likely that physicists will talk about a new particle that has a signature consistent with the Higgs but has to be investigated further.

CERN hinted at that approach last week in the news release announcing Wednesday's webcast. "It's a bit like spotting a familiar face from afar," said the center's director general, Rolf Heuer. "Sometimes you need closer inspection to find out whether it's really your best friend, or actually your best friend's twin."

Gigi Rolandi, a senior research physicist at CERN, used a similar analogy in a video released this week, referring to crops of corn (which he calls maize, as most Europeans do), wheat (which he calls corn) and poppy flowers. Some particles are as easy to spot as a red poppy in a wheat field, he said. But not the Higgs.?"The search for the Higgs is more similar to looking for a single plant of maize among many, many corn plants, than looking for a poppy among the corn," he said.

We'll get a foretaste of Wednesday's proceedings on Monday, when Fermilab is due to provide its final update on the Higgs boson search, based on the full set of data from the now-closed Tevatron. Will Fermilab try to steal some of CERN's thunder, at least for a couple of days? Stay tuned....

The Philadelphia Flyers announced Terry Murray will be the new head coach for the Adirondack Phantoms.

"We feel very fortunate to be able to bring Terry back to the Flyers organization as head coach of the Phantoms," Philadelphia general manager Holmgren said. "Terry brings a wealth of knowledge and experience, is an excellent teacher and a strong believer in the development process of young players."

"Terry has a long and successful history of winning and developing players," added Phantoms president Jim Brooks. "We look forward to him joining our Phantoms staff."

"I really appreciate the opportunity to come back to the Flyers organization, and I'm really looking forward to the challenge that's out there of coaching the Phantoms," Murray said. "The youth playing down in the American Hockey League is a real important part of the organization. I'm looking forward to the challenge of getting back into the playoffs and helping these young players develop and become NHL players as quickly as possible."

This is Murray's third stint as a coach. He was head coach of the Flyers from 1994-97, winning the Stanley Cup in 1997. He was 118-64-30 in 212 games with Philadelphia. In 1,012 NHL games as head coach, he is 499-383-89-41.

China marks HK handover anniversary with local military parade

Chinese President Hu Jintao on Friday urged Hong Kong's restive people to embrace the motherland as he visited the financial citadel for the 15th anniversary of its return to rule by Beijing.

Hu, whose three-day visit is his last as president before a key leadership reshuffle in Beijing, will preside over the inauguration of Leung Chun-ying as the city's next chief executive on Sunday.

But while he vowed to "walk more" and "see more" in Hong Kong, the first order of business on Hu's trip was a parade in front of the massed ranks of China's secretive military garrison.

The president stood to attention in an open-top vehicle, microphones arrayed in front of him, as he moved down the line of People's Liberation Army personnel, tanks and missile launchers in Hong Kong's remote New Territories.

"Thank you for your efforts comrades!" Hu, wearing a green uniform, shouted. The PLA members answered with a cry of "serve the people!" A huge banner aloft read "Love the motherland, love Hong Kong".

But polls indicate the highest level of anti-China discontent among Hong Kong's seven million populace since the 1997 handover from Britain, and the reaction on social media to the military show was caustic.

"It feels like we are in North Korea," one Hong Konger wrote on Facebook.

Several groups plan protests for Hu's visit despite a stifling police deployment. A march on Sunday is expected to draw tens of thousands demanding greater democracy and accusing Beijing of interfering in local affairs.

Authorities have erected giant barricades measuring more than two metres (6.5 feet) high around Hu's five-star hotel. Well away, one small knot of protestors on Friday kept up a clamour through a loudhailer.

Hu's schedule in Hong Kong has not been made known, apparently due to security concerns, apart from his expected attendance at Sunday's inauguration ceremony and a variety show to celebrate the anniversary on Saturday.

Prior to the PLA inspection, the Chinese president held a closed-door meeting with outgoing Chief Executive Donald Tsang and thanked him for his service. Tsang is stepping down after seven years in office.

His successor Leung was chosen by an election committee stacked with pro-Beijing elites, and many among the ordinary public say they feel disenfranchised amid a widening rich-poor gap and an influx of mainland cash.

"In the coming two days, I hope to be able to walk more, see more and personally feel the development of Hong Kong, understand the life and expectations of the Hong Kong people," Hu said on his arrival.

He said Hong Kong had achieved "significant" development since the handover and that the "one country, two systems" model, which guarantees the southern Chinese city a semi-autonomous status, had been upheld.

Hu, who last visited Hong Kong in 2007 for the 10th handover anniversary, also urged unity between Hong Kongers and their northern neighbours.

"The central government would like to use the valuable experience gained over the past 15 years with the people of all sectors in Hong Kong to unite together and look forward to further promote the practice of 'one country two systems'," the Chinese leader said.

Under the "two systems" principle, Hong Kong retains its own judicial and financial frameworks, with civil liberties including the right to demonstrate and press freedom not seen on the mainland.

Hu is expected to announce measures aimed at enhancing economic cooperation between Hong Kong and Beijing during his visit, as part of China's use of the city as a testing ground to turn the yuan into a global currency.

Chinese officials on Friday announced incentives for a financial zone in Shenzhen, close to the Hong Kong border, which will be jointly developed by both sides. It is due for completion by 2020.

Despite the closer integration, unease has been growing as Hong Kongers chafe at an influx of newly rich Chinese mainlanders, accusing them of taking everything from school places and maternity beds to baby milk formula.

A telephone poll of more than 1,000 people released last week by the University of Hong Kong showed mistrust among Hong Kongers toward Beijing at a new post-handover high of 37 percent.

By contrast, a poll released in August 2008 after the Beijing Olympics showed the figure at a relatively low 14 percent, when nationalistic sentiment was strong throughout China.

Prior to the handover, mistrust levels stood at 44 percent in May 1997.
