What can you tell me about UTMA and investing in gold, silver ...

I understand the UTMA regulatings prohibit minors from directly owning equities. Do these same limitations implement to gold, silver, oil, aluminum, steel, etc.? If not, what would you suggest to invest in, and is this scheme better than laying out capital in such other means as mutual funds, bonds, or cash market accounts? ThanksI'm not sure I understand your statement ?UTMA regulatings prohibit minors from directly owning equities?. A UTMA account CAN own stocks. I suppose that technically the minor doesn't own the stock since it's the account's ?trustee? (normally a parent or guardian) that has legal obligation for the account, but the account is for the gain of the minor and may legally only be used for things that gain the minor (e.g. college tuition, summer camp, etc.) so for all practical intents it's the same thing.I don't recognise of any rules that prohibit ownership of things like gold and silver, though I suppose it's possible. I've never read the UTMA rules word for word and have never invested in commodities in my kids' UTMA accounts. I personally would question the wisdom of buying into things like that now anyway. Nearly all commodities have risen dramatically in price over the last year or two. While a sure amount of that is basic supply/demand, I think a lot of it is speculation (i.e. persons looking to make a quick buck buying into the latest fad investment). We've seen what happened with tech stocks with regards to 7 years ago and real estate over the past couple years. I think there's a good prospect that the same thing (a price collapse) could take place in the commodities that have run so far up in price. As soon as there's a amount of time of declines, I suspect that a heap of of the speculators will bail out driving prices down even more. I personally think commodities are a high peril investment at this point. As for what the best thing to invest in, that will vary depending on how soon the cash is needed, danger tolerance, etc. Over long periods of time, however, stocks have with respect to history provided the most eminent returns of any asset class, so that's my preferent investment for long-term gains.

5One Fantastic Collaboration
By Rude Cactus
Hand me a Patterson novel and I?ll read it. Hand me a Karp novel and I?ll devour it. Kill Me If You Can is a outstanding marriage of two solid writers. While it follows the typical Patterson formula, there?s something fresh and stimulating in the writing, likely due to Karp?s unbelievable talent. I hope this will be the basi of numerous collaborations while also highlighting what a gifted writer Karp is. In the mean time, be sure to check out Karp?s Lomax & Biggs novels ? The Rabbit Factory, Blood Thirsty, Flipping Out and Cut Paste Kill.

Toyota, Honda facing tough new challenges

?This launch is very important for our company,? proclaimed Akio Toyoda as he walked into the heart of the Georgetown, Ky., assembly plant that just started to build the new 2012 Toyota Camry.

?The car has become a symbol of Toyota?s success and an opportunity to show the world again what Toyota is all about,? he said.

The fact that Toyoda ? the grandson of the Japanese automaker?s founder and himself the company?s current CEO ? came to Kentucky only underscored the critical role of the new Camry. The sedan has been America?s best-selling passenger car for the last nine years running. But production shortages resulting from Japan?s March earthquake and tsunami make it less likely the Camry will repeat that feat for 2011.

The shortages, in fact, only complicate matters. Toyota is still trying to live down the quality and safety problems that seemed to land it unflattering headlines almost every week in 2010. While recent reports suggest those problems are on the mend ? even as Toyota plants resume normal production ? initial reviews of the new Camry can be charitably described as mixed.

Toyota isn?t the only Japanese car giant facing unexpectedly tough challenges. Honda was slammed by the March 11 natural disaster. Its new, 2012 Civic ? as important to Honda as Camry is to Toyota ? has been in short supply since its aborted spring launch, and the car won?t be back to normal inventory levels until the fall, according to John Mendel, the top U.S. executive at Honda of America.

Story: Toyota unveils first Camry redesign in 5 years

The new Civic has also taken sharper blows from the media than the Camry. The highly influential Consumer Reports magazine recently declared that the redesigned subcompact now ?ranks near the bottom of its category.?

That review is something the automaker takes "very seriously,? said Mike Accavitti, the new marketing chief for Honda.

How much of an impact the headlines will have on Toyota and Honda sales ? once production is back to normal ? remains to be seen. But industry analysts say there?s reason for the Japanese carmakers to worry.

The two automakers have some of the highest loyalty rates among new car buyers, but depending on current owners to carry things forward may be asking too much. Indeed, nearly half of Toyota and Honda sales still come from ?conquests,? when a car shopper trades in a competitor?s product. And those are the car buyers most likely to be impacted by last year?s headlines and this year?s poor car reviews.

?A lot of people who buy Toyotas and Hondas look to Consumer Reports to validate their decisions about what to buy next,? said Dave Sullivan, automotive analyst with AutoPacific, Inc.

Bad reviews mean the two Japanese giants could ?have a harder time? winning over the conquest buyers, ?especially after they see what the new competition has to offer,? he added.

Traditionally rated at the back of the pack, cars made by U.S. and Korean automakers, such as the Ford Focus and Hyundai Elantra subcompacts, are suddenly winning rave reviews. The Chevrolet Cruze, the replacement for the unloved Chevy Cobalt, has recently landed at the top of the sales charts.

?The marketplace is a dogfight,? acknowledged Honda?s marketing chief Accavitti. ?In all my years I haven?t ever seen so much competition in darn near every segment.?

Still, Accavitti insists that buyers will downplay criticism of the Civic ? as well as a subsequent Consumer Reports article that took aim, more broadly, at Honda itself. The brand?s long-term reputation, he contends, ?will drive buyers into the (Honda) showroom.?

Not everyone is so sanguine, however, and a number of analysts are betting that the conventional automotive order could be up for grabs over the next several years even after production levels return to normal.

That has led upstart carmakers ? both domestic and Korean ? to increase the pressure on their rivals. They?re rolling out more new products, adding more standard features and, in many cases, piling on the incentives to try to lure in once-loyal Toyota and Honda buyers while supplies of those carmakers? cars are still short.

But Toyota is fighting back. It has started ratcheting up incentives in recent months and, significantly, it will drop the price on various Camry models by as much as $2,000 when the 2012 edition officially goes on sale in October.

Story: Car sales help drive away double-dip fears

That?s a difficult decision considering current exchange rates. At the currently lopsided 76 yen to the dollar, it?s almost impossible for Japanese carmakers to make money on cars imported from Japan ? and even those assembled here, like the Camry, are penalized for every part imported from the home market.

But losing ground with Camry would be even more costly, and the carmaker will do everything it can to back up a promise by Toyota division boss Bob Carter that the midsize sedan ?will continue to earn its position as America?s number one-selling passenger car.?

As for Honda, Accavitti insists his company won?t do what his former employer was prone to do ? dump cars into low-profit car rental fleets just to make its sales numbers. Honda hasn?t ramped up incentives to the degree Toyota has, but that may be only a matter of time. The test will come this autumn when Honda effectively re-launches the new Civic with a major ad campaign.

Toyota, meanwhile, will attempt to overwhelm the critics with what Carter promises to be the most expensive launch budget in its history.

The industry giant has the muscle ? and it will now need to use it more than ever. The era when Honda and Toyota could simply introduce new products and expect buyers to flood to the showrooms may be over.

Is oil leaking in the Gulf from the BP spill site? (The Christian Science Monitor)

Reports of oil surfacing near the site of the Deepwater Horizon explosion are raising questions about its source and whether it is related to last year?s oil spill in the Gulf of Mexico ? one of the worst environmental disasters in US history.

A patch of oil was documented last week about a quarter-mile northeast of the Macondo wellhead leased by BP. That site was plugged in July 2010 after about 4.9 million barrels (206 million gallons) of oil leaked into the Gulf.

On Wednesday, reporters from the Mobile, Ala., Press-Register published photographs and video of their discovery on the news organization?s website, which was in response to surveillance flights conducted the week before by two environmental groups ? the Gulf Restoration Network and On Wings of Care. The Press-Register reported witnessing ?blobs of oil rise to the surface and bloom into iridescent yellow patches? that later ?expanded into rainbow sheens 4 to 5 feet across.?

IN PICTURES: Sticky mess ? the Gulf oil spill's impact on nature

The reporting expedition collected oil samples that later underwent chemical analysis at a Louisiana State University lab headed by Edward Overton, an oil chemist who was tapped by federal investigators to study the oil in the early weeks of the spill. Mr. Overton confirmed that the oil was south Louisiana crude, but because of the low concentration of samples, testing could not determine that it was MC252 ? the specific oil that can be traced to the Macondo well.

???There is no way to say for sure whether the well is leaking, based on what is on the surface. Of course it is suspicious,??

Other scientists involved in studying the oil spill echo Overton?s feelings, saying the large quantity of oil on the surface raises doubt the oil is the result of natural seeps ? a phenomenon caused by the combination of oil and methane gas escaping from the seafloor. Natural seepage if often identified off the coasts of Louisiana and Texas and produces a much lower concentration of oil than spills caused by humans.

???Based on my experience in working and boating in this area, the amount of oil I have seen on the surface from recent photographs and videos is not normal,??

Natural seepage from the seafloor typically occurs in shallow depths of 1,000 feet or less, says Michel Boufadel, chairman of the department of civil and environmental engineering at Temple University in Philadelphia, who worked with Overton following the BP spill. Since the Macondo site is 5,000 feet below the surface, the only way oil can get pushed to the surface is through a violent eruption on the seafloor, Mr. Boufadel says.

?It is possible the oil was brought up by a natural seep, but that?s not probable because the depth [of the Macondo site] is so significant.... The eruption has to be big enough,? he says.

BP is denying the oil originated from its wellhead or the two relief wells, which were permanently sealed with cement in September 2010. On Thursday last week, the company directed several remotely operated vehicles to the well and provided a live feed of the operation to officials from several agencies, including the US Coast Guard; the Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE); the National Oceanic and Atmospheric Administration (NOAA); and state representatives from Louisiana, Mississippi, and Florida.

?All these people agreed that nothing from the video footage showed any indication there was leaking from the wellhead,? says Lt. Suzanne Kerver, a spokeswoman for the US Coast Guard?s Eighth District in New Orleans. Kerver says her agency also conducted multiple aerial flights to survey the area and found ?no evidence? of oil on the surface of the water.

BP said in a press release that ?small intermittent [nitrogen] bubbles were observed emanating from cement ports at the base of the wellheads.? This is a natural byproduct of the nitrified foam used to set the casing cement, says BP spokesman Daren Beaudo. The company does not regularly monitor the Macondo site for leaks, he says.

BP has also raised questions about the oil samples collected by the Press-Register. ???We haven???t seen the samples that were reviewed that Mr. Overton looked at,??

There are many reasons that oil appears on the surface in the Gulf of Mexico besides natural seepage, the Coast Guard says. They include leakage from pipelines, sunken platforms, active and abandoned wells, and vessels.

It is not uncommon that many cases involving surface oil remain unresolved. In 2010, the Coast Guard said that it received 2,231 reports of oil sheen in the Gulf; the origins of 372 cases remain unknown.

The disconnect between what environmental groups, media organizations, and academics are finding and the results from BP and federal authorities is causing some to say that an independent group is needed to monitor oil sheens in the region, particularly near the Macondo site.

?There?s still a ton of questions out there regarding where [the oil] is from, and it?s on the Coast Guard to figure it out and to let the public know,? says Dan Favre, communications director for the Gulf Restoration Network.

Professor Bea says it is difficult for independent investigators to verify assertions the leak did not originate on the seafloor or at the wellhead because BP, the Coast Guard, and BOEMRE are not releasing their evidence to the public.

?Purportedly, sea floor videos at and in the vicinity of the Macondo well have been gathered, not provided. Only ?summary statements? have been provided that have not given any definitive information on the sources of the oil escaping to the surface,? he wrote.

A BOEMRE spokeswoman said her agency would not comment on the situation.

Kerver of the Coast Guard said that she would ?not speculate where these sheens came from,? but that the Coast Guard will soon post video feeds of the BP underwater surveillance on its website.

Toughest Cowboy Presented by J?germeister Returns Bigger, Better ...

Second season of world?s toughest reality show airs nationwide on FSN.

Grit Rock Rodeo and AEG?s Toughest Cowboy Presented by J?germeister is sure to be the toughest reality show ever, whether on television or in person. Twelve cowboys will strap in for the most mentally and physically demanding rodeo competition on the planet, competing in three disciplines per night to win over 30 acres of beautiful prime Colorado Rocky Mountain real estate, called the J?ger Ranch.

The second season of the Toughest Cowboy competition will continue the Rodeo Revolution, doing something else no other rodeo has ever done. All rodeos are demanding, but the Toughest Cowboy events require its cowboys to compete in three gut wrenching, roughstock disciplines each night ? bareback riding, saddle bronc riding, and bull riding ? all in match play against one another. For those tough enough to make it to the Championship round, they will need to make an historic commitment to toughness and grit as they will compete and ride an unprecedented 6 times in one night!

Winning A Piece Of The American Dream

This season, the stakes are even higher than last year, with each of the competitors vying not only for the title of Toughest Cowboy, but also for a piece of the American Dream ? the deed to the J?ger Ranch in Colorado.

?We wanted to attract the best talent in all of rodeo to compete in Toughest Cowboy,? said Tommy Joe Lucia, Vice President of Grit Rock Rodeo. ?We knew there is one thing that every cowboy wants, a ranch, and together with our friends at J?germeister, we were able to make the ultimate top prize a reality.?

Attracting the Toughest Competitors

It?s that land that brought B.J. Schumacher into the competition this year. He is a bull rider by trade ? and a very good one at that ? he was the 2006 PRCA World Bull Riding Champion, and set a new earnings record in the process. That wasn?t enough, though, Schumacher knew that his rodeo career would not be complete without taking a shot at the Toughest Cowboy crown.

Also back this season is Bandy Murphy, the Toughest Cowboy defending champion. After capturing the title in 2007, the Weatherford, Oklahoma native is looking to keep the title in his hands and already has plans for what he wants to do with the J?ger Ranch.

Schumacher and Murphy are just two of the cowboys competing for the title of Toughest Cowboy Presented by J?germeister and a piece of the American Dream ? stay tuned to see who rides into the sunset to their very own ranch

Fans Witness the Rodeo Revolution Live

The drama and excitement of the live tournament competition begins on December 29 at the sparkling new Sprint Center in Kansas City Missouri. Through nine competitions, the season will conclude on February 16 at Nationwide Arena in Columbus, Ohio when the new champion will be crowned.

By the championship round, each of the competitors will have participated in eight weeks of the most dangerous and physically demanding competition in all of rodeo. In addition, fans watching at home will have had the chance to get to know each of the cowboys, their stories and what makes each of them so unique.

The New Television Season

The 10-episode second season of Toughest Cowboy kicked off on January 4, 2008 and will be televised on FSN weekly in primetime (day and time depend on each affiliate) and then replayed the following Saturday at Midnight. Beginning with Episode 2, each tour stop will be televised and will take fans into the heart of the action to savor the triumph, suffer the anguish, and share the intensity of the ultimate challenge that is Toughest Cowboy Presented by J?germeister.

Corporate America Rallies Behind Toughest Cowboy

While J?germeister is the Presenting Sponsor of Toughest Cowboy, it is far from the only corporate partner for the series. Corporate America has responded to the unique competition and several major partners will each sponsor a ?cowboy? in Toughest Cowboy. The roster of sponsors also includes: Polaris, The Home Depot, Wrangler, Super Clean, FSN, Reelz Channel, RedCreekland.com, and Priefert Ranch Equipment.

About Grit Rock Rodeo

Grit Rock Rodeo is one of the largest producers of live and televised rodeo events in the world. Grit Rock Rodeo owns the World?s Toughest Rodeo, a national touring rodeo that consists of World?s Toughest Bulls and Broncs and Toughest Cowboy.
